CONTACT: Re S (Contact Order)

(Court of Appeal; Thorpe, Moore-Bick and Aikens LJJ; 23 February 2010)

An unmarried mother applied for a residence order. The father favoured shared residence. An order was made in terms of a specific issue order, but not a contact order.

Appeal allowed. The contact order could not be made unless attached to a residence order. The court could not use a specific issue order to produce a result that could be achieved by a residence or contact order.
