(Court of Appeal, Longmore, Black LJJ, Dame Janet Smith, 16 October 2012)
The parents were unable to care adequately for their children, aged 6 and 4, due to issues with alcohol and domestic violence. When final care and placement orders were made they appealed. The mother claimed she had been engaging in therapy and would be able to care for the children. The parents were also opposed to the prospective adopters who were a gay couple.
Appeal dismissed. The judge was right to conclude that there were too many uncertainties surrounding the possibility of the parents being able to care for the children to allow them to lose the prospective adoption placement. The new report emphasised the mother's engagement with therapy in the last 4 weeks which was focused more on her own needs than her ability to parent and would not have altered the judge's conclusion.
