CARE PROCEEDINGS: Lewisham London Borough Council v D (Local Authority Disclosure of DNA Samples to Police)

(Family Division; Stephen Cobb sitting as a deputy High Court judge; 17 February 2010)

The police requested DNA samples held by the local authority who had taken the samples from the children to assist in their enquiry into whether the woman accused of abusing them was their mother or a child trafficker. The police wished to have access to the samples for their own criminal investigation into the woman's activities.

Held that the children's samples to be disclosed. The disclosure of children's samples did interfere with the children's Art 8 rights, but this was proportionate and necessary for the prevention of crime and the protection of rights and freedoms of others.
