CAFCASS AND THE NATIONAL ASSEMBLY FOR WALES PRACTICE NOTE 2006 APPOINTMENT OF GUARDIANS IN PRIVATE LAW PROCEEDINGS

The accompanying Practice Note sets out practical guidance to the judiciary on such matters as:

  • the wording of an order appointing a guardian;
  • the appropriate office of CAFCASS/ CAFCASS Cymru to which the order and court papers should be sent;
  • timescales for notification; and
  • the assistance that can be provided by the lawyers in CAFCASS Legal and the Welsh Assembly.

The main aim of the Practice Note is to ensure that court requests to CAFCASS/CAFCASS Cymru to appoint a guardian in private law matters are dealt with in a consistent and timely manner and are referred to the appropriate office to avoid delays in allocation.

The new Practice Note also sets out a clearer set of criteria as to which cases should be referred to the CAFCASS High Court Team or Assembly Lawyers rather than to the local CAFCASS/CAFACSS Cymru offices.
