The family lived in Dubai but when the parents separated the mother was prevented from removing the two children from the jurisdiction. The mother issued proceedings in England and during which an order for costs was made. The English court held that the Dubai courts were best placed to determine the substantive matters. The question now arose whether the English court retained jurisdiction.
The court held that jurisdiction lay with the Dubai courts. The previous order provided for recognition in Dubai. The judge's comments in the costs judgment in no way expressed a belief that jurisdiction should be retained in England.
On a matter of procedure both counsel had failed to file documents in compliance with Practice Direction relating to court bundles.
