An Alternative View of Duxbury: a riposte

LEWIS MARKS QC, Queen Elizabeth Building

In their article ‘An Alternative View of Duxbury' published at [2010] Fam Law 161, Debbie Phillpotts and Simon Bruce argue that it is ‘time for a re-think' of the Duxbury model and approach. In fact, and as they recognise, the model is kept under regular review and the most recent tables published in At a Glance (FLBA, 2010) incorporated a bit of quantitative easing recognising, not any perceived difficulty over the longer term in achieving the rates of return assumed in the model as a whole, but rather the short term issue of identifying the appropriate investment vehicles in which in the current climate to embark while awaiting hopefully more buoyant economic waters.
