The parties' main source of income during the marriage was the family business. When the parties divorced the wife sought maintenance payments from the trustees. An offer for some provision was made during proceedings but the wife rejected it and sought a more generous award. Her case was that they should provide the husband with a higher income so that he could afford to pay her.
In refusing the wife's application, the judge held that the position of the trustees was reasonable and that they had sought to make a lifetime provision for her.
