The mother was charged with murder of her child but was acquitted because doctors thought the child might have died as result of a fall. The local authority wanted a fact finding hearing.
Held that there was no need for a fact finding hearing taking into account the Guidance and applying the overriding objective. The proceedings in relation to the younger child could be dealt with without a fact finding hearing to establish how the older sibling had died.
