The father was acquitted of murder/manslaughter of a child by a previous relationship. The Local Authority was involved with the father's second family after the child suffered severe burns while in the mother's care. The mother pleaded guilty to neglect. The Local Authority also believed she had emotionally abused children.
At issue was whether it was necessary to conduct a fact-finding hearing in relation to alleged offences that father was acquitted of. The court held that it was not necceasary to do so.
