ANCILLARY RELIEF: M v M [2010] EWHC 2817 (Fam)

(Family Division; King J; 19 October 2010)

An application for interim maintenance within Part III proceedings. A Russian couple both living in England. After the wife left the husband taking two children with her, the husband provided her with no financial support and  had not provided information about his means in contempt of court. She was instead being supported by a female friend who was providing her with rent etc. The husband was still living in a £4 million house in joint names.

A Hadkinson order was made so that the husband was not heard on the application (this was not precluded by his being the respondent and was Art 6 compliant), and an order for interim maintenance with an element for legal fees.
