(Family Division; Hogg J; 7 September 2010)
The mother was killed by the father and paternal grandparents took care of the two children. The father was sentenced to 7 years for manslaughter. A social worker allocated who was unable to arrange contact with the maternal grandparents and interim residence orders made in favour of paternal grandparents.
The court gave extensive guidance in cases where one parent has been killed by the other. Although in this case it was not the children's best interests to break the attachment with the paternal grandparents, expert evidence was that generally children should not be placed within the perpetrator's family. Care and special guardianship orders were made. The maternal grandparents would have extensive contact.
