Employers who make 20 or more redundancies at an establishment are required to consult employee representatives over proposed redundancies. The ECJ establishes in this case that ‘establishment’ here means the individual workplace and not the employer as a whole. Therefore when two large retailers made redundancies at numerous retail stores, they were only required to consult at those workplaces where 20 more redundancies were proposed.
