The early conciliation procedure, which claimants have to go through in most cases before they can present a claim to the employment tribunal, extends the three-month time limit for bringing claims by one month from the date of the Early Conciliation Certificate (ie the certificate from ACAS showing that the early conciliation process has been completed). That additional one month expires on the corresponding date of the following month after the date of the Early Conciliation Certificate.
T was dismissed on 20 March 2015. He contacted ACAS on 18 June 2016. The Early Certification Certificate was dated 30 June 2016. The claim was presented on 31 July 2016. The employment tribunal and EAT held this was one day too late. The one month extension of the time limit expired on the corresponding date in July of 30 June (the date of the certificate).
