European Court of Justice
The EAT follows the decision of the CJEU in Pereda v Madrid Movilidad SA and holds that a worker who is off sick for a whole year and is thereby prevented from taking their leave entitlement under the Working Time Regulations must be allowed to take that leave at a later time, if necessary in another leave year.
