WM Morrison Supermarkets plc and Others v MasterCard Incorporated and Others [2013] EWHC 1071 (Comm); [2013] UKCLR 197

On 3 May 2013, the High Court rejected an application by the defendants to a claim for damages for a stay pending an appeal against an EU Commission infringement decision to the CJEU. The Court held, having regard to the CPR requirements to deal with a claim justly, that the claim could proceed at least to a case management conference at which a further decision could be made.
