W.H. Newson Holding Ltd and Others v IMI plc, IMI Kynochi plc, and Boliden AB [2012] EWHC 3680 (Ch); [2013] UKCLR 122

On 19 December 2012, the High Court held that s 47A of the Competition Act 1998, which provides for follow-on actions, applied to any relevant monetary claim, and refused to strike out a claim based on the tort of unlawful conspiracy in relation to a cartel subject to an Art 101 TFEU infringement decision.
