The Office of Fair Trading v Somerfield Stores Ltd and Co-operative Group Food Ltd [2014] EWCA Civ 400; [2014] UKCLR 1215
On 7 April 2014, the Court of Appeal overturned a judgment of the Competition Appeal Tribunal (CAT) allowing an extension of the time period in which an appeal could be made against an Office of Fair Trading (OFT) infringement decision. The Court held that the circumstances were not ‘exceptional', and that the CAT had misinterpreted the relevant test.
