Tesco Stores Ltd and others v Office of Fair Trading [2012] CAT 6, [2012] CompAR 188

In the course of an appeal against an infringement decision relating to the sale of cheese, the Tribunal rejected an application for disclosure sought by the OFT. The Tribunal found that evidence relating to witnesses contacted by Tesco after the making of the Statement of Objections was protected by litigation privilege, and was, in any event, unnecessary.
