SRCL Ltd v Competition Commission [2012] CAT 14 [2012] CompAR 417

On 24 May 2012, the CAT dismissed SRCL's application under s 120 of the Enterprise Act seeking to overturn findings of the Competition Commission in relation to the Stericycle/Ecowaste Southwest merger. The Tribunal held that the Competition Commission had acted within its discretion throughout, and that a ‘no-minimum price' backstop clause was designed to encourage a swift sale.
