No award of costs

The Competition Appeal Tribunal has dismissed an application by Durkan that the OFT should pay a significant part of the costs of the appeal in the construction cartel ([2011] CAT 17, [2011] CompAR forthcoming). Durkan was successful in part on its appeal on liability and had its fine reduced from £6.72m to £2.44m.
