Investigation into transatlantic joint venture

On 27 January 2012, the European Commission announced that it had opened a formal investigation to assess whether the transatlantic joint venture between Air France/KLM, Alitalia and Delta breaches Art 101 TFEU. The joint venture provides for coordination under which the parties coordinate schedules, capacity and pricing and share profits and losses on trans-Atlantic flights. The Commission is concerned that this tie-up may harm passengers on EU-US routes.
Simultaneously, the Commission announced that it has closed its investigation of co-operation between eight members of the SkyTeam airline alliance, including Air France/KLM, Alitalia and Delta, a decision which was taken by the Commission as part of its priority-setting process in light of significant changes in the circumstances on the relevant markets.
