Interclass Holdings Ltd and Interclass plc v Office of Fair Trading [2012] EWCA Civ 1056; [2012] UKCLR 304

On 31 July 2012, the Court of Appeal upheld, in part, an appeal against the level of penalty determined by the Competition Appeal Tribunal following an infringement of the Chapter I Prohibition of the Competition Act 1998. The Tribunal had reduced the penalties imposed by the Office of Fair Trading. The Court of Appeal held that the penalty imposed was disproportionate to those imposed on other parties to the same original infringement decision, and should be reduced accordingly.
