Interclass Holdings Ltd and Interclass plc v Office of Fair Trading [2012] EWCA Civ 1056, [2012] UKCLR 304

On 31 July 2012, the Court of Appeal held that the Tribunal had erred its assessment of a penalty following the Office of Fair Trading's Decision relating to cover-pricing in the construction industry. The Court found that the Tribunal application of a multiplier resulted in a consequence which was disproportionate and unjust, and reduced the penalty accordingly.
