ECSL and findings of fact

On 19 January, the Court of Appeal dismissed an appeal by Enron Coal Services Ltd (ECSL) against a judgment of the CAT to the effect that ECSL failed in its action seeking damages from English Welsh & Scottish Railways (EWS) for abuse of dominance, because it failed to prove causation ([2011] UKCLR 303).
