Deutsche Bahn AG & Others v Morgan Crucible Company plc and Others [2012] EWCA Civ 1044, [2012] UKCLR forthcoming

On 31 July 2012, the Court of Appeal found that the Competition Appeals Tribunal had erred in its judgment that a follow-on claim brought by the appellant was time-barred. The matter turned on the question of what appeals to the General Court from the Commission Decision would be relevant in determining the relevant time-period. In summary the Court held that all appeals against a Decision were to be taken into account.
