On 31 July 2012, the Court of Appeal found that the Competition Appeals Tribunal had erred in its judgment that a follow-on claim brought by the appellant was time-barred. The matter turned on the question of what appeals to the General Court from the Commission Decision would be relevant in determining the relevant time-period.
