Competition Law in a New Territory: Adapting to the Revocation of the Land Agreements Exclusion Order [2011] Comp Law 319

In April 2011, land agreements ceased to be excluded from the application of the prohibition of anti-competitive agreements contained in Chapter I of the Competition Act 1998. This article considers how the Chapter I prohibition applies to land agreements, by outlining the key aspects of the OFT's recent guideline on this subject. The article sets out the background of the Land Agreements Exclusion Order and its revocation, discussing the substantive elements of the Chapter I prohibition in relation to land agreements. It also describes the OFT’s approach to taking enforcement action in relation to land agreements following the change in the law.
