Bord Na Mona Horticulture Ltd and Bord No Mona plc v British Polythene Industries plc, Combipac BV, Bischof, Klein GmbH & Co KG and FLS Plast A/S [2012] EWHC 3346 (Comm); [2013] UKCLR 50

 

On 28 November 2012, the Court of Appeal refused to strike out a claim against BPI plc, an Irish company. The EU Commission had found in its infringement decision that a cartel operated in certain markets, but did not include the UK as being amongst these. The judgment is important in that the Court discusses the standard required for claims in competition law.
