Association of Convenience Stores and National Federation of Retail Newsagents v Office of Fair Trading and Press Distribution Forum [2012] CAT 27; [2013] CompAR 1

On 24 October 2012, the Tribunal rejected an application for judicial review of an Office of Fair Trading (OFT) decision not to conduct an update review of its decision not to make a market investigation reference in relation to newspaper and magazine distribution. The Tribunal applied the Wednesbury standard, and held unanimously that the OFT had not made an unreasonable decision.
