DAVID RICHARDS J:

The court considered whether an application under thethe court considered whether an application under the European Insolvency Regulation (EC) 1346/2000, required the company in question to be insolvent and, if so, whether the application had to be based on that insolvency. 

[1]        This is an application by ARM Asset Backed Securities S. A. (the company) for the appointment of provisional liquidators of the company under the Insolvency Act 1986.
