The court considered an application that the company be wound up on the just and equitable ground under the Insolvency Act 1986, s 125(2,) and an application based on the allegation that the affairs of the company had been conducted in an unfairly prejudice manner under the Companies Act 2006, s 994 (see 19[12])    

 

[1]        The Petitioner (Mrs Maresca) and the Second Respondent (Mr Pursall) had a personal relationship which started in 1997 and ended at the beginning of 2011. This present Petition seeking the winding up of Brookfield Development and Construction Limited ("BDC") is part of the fall out of that breakup.
