Cancellation of contracts entered into before 13 June 2014
The Law Society has issued a Practice Note on cancellation of contracts entered into before 13 June 2014.
On 13 June 2014, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 came into force, superseding the Cancellation of Contracts made in a Consumer's Home or Place of Work etc Regulations 2008 with respect to contracts made on or after 13 June 2014.
The 2008 Regulations continue to apply to off-premises contracts entered into before 13 June 2014 and are likely to apply to a wide range of contracts made between solicitors and their clients. Whether they apply will depend on the nature of the client and the circumstances in which the contract was made (including the date the contract was entered into). Where the 2008 Regulations apply, the client has a right to cancel the contract within a 7-day period. The solicitor must give the client written notice of this right, setting out various prescribed information. Failure to do so is a criminal offence.
The Practice Note considers the circumstances in which the 2008 Regulations apply to contracts between solicitors and their clients, and explains the consequences if the Regulations do apply.
