March 2015 - Spring Update

The Spring Update is packed with interestingnew developments, including a comprehensive new module on Appeals which is nowlive.

New: Appeals

There are 6 new Practice Notes contained in this sectionwhich cover all major routes of appeal, accompanied by 8 interactive FlowCharts to assist practitioners in identifying and following the appropriateprocedure. The Practice Note forJudicial Review considers the Pre-action Protocol and obligations under theCivil Procedure Rules 1998, Part 54 and the accompanying PracticeDirections. The Practice Note onApplications based on supervening events (Barderappeals) and applications to set aside an order considers the powers of thecourt and whether to appeal or apply to set aside an order and the procedurefor appeals out of time. The remainderof the series deals in depth with appeals from all tiers of court including laymagistrates, up to the Supreme Court. The Practice Notes deal with applicationsfor permission and compliance with governing legislation and rules includingFamily Procedure Rules 2010, Part 30 and Practice Direction 30A through to theSupreme Court Rules 2009. Conduct ofappeals is considered following Piglowskav Piglowski [1999] 2 FLR 763, together with leapfrog appeals, documents to be filed and methods of service, allaccompanied by a range of practical tips.

The section is an indispensable resource for practitioners,enabling them to tackle the complex and fundamentally important area ofappealing decisions.

All practitioners are likely to need to advise on issues ofenforcement at some point, which affects all family and matrimonial matterseven if applications are not being made on a day to day basis.Our new Practice Plus module: Enforcementwill be invaluable for practitioners, enabling them to tackle this thornyarea.The module contains 12 substantivePractice Notes which cover all major methods of enforcement, together with 2helpful overviews to assist practitioners in identifying which method ofenforcement to use when.The moduleincorporates the changes brought about by the introduction of Part 37 of theFamily Procedure Rules 2010, which introduces a new procedure for committalproceedings.
